The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of the jurisdiction in which Olive Grove Estates operates.  Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

 Services – Applicable for Vendors:

  1. Property Sale Agreement: a. You agree to advertise with Olive Grove Estates, either in the exclusive or non-exclusive manner, for the minimum time of 6 months. b. Olive Grove Estates will work diligently to market and sell your property. In the event that you decide to withdraw from our arrangement before the agreed-upon time-frame or, the following conditions apply:

  2. Media Costs: a. Media costs include expenses incurred for advertising, marketing, photography, videography, property staging, and any other related promotional activities aimed at promoting your property. b. You acknowledge that media costs are essential for the effective marketing of your property and agree that Olive Grove Estates will incur these costs on your behalf.

  3. Liability for Media Costs:

    a. If you choose to terminate our services prematurely, you will be liable for all media costs incurred to date.

    b. You agree to reimburse Olive Grove Estates for the full amount of media costs incurred, as outlined in any invoices or statements provided by us.

    c. The initial advertising length shall be considered the primary determinant for the calculation of media costs. Reactivation of any advertisement after termination does not contribute towards the fulfillment of the initial advertising period.

    d. For the purpose of calculating the 6-month period mentioned in clause (a), only the continuous and uninterrupted duration of the initial advertising length will be considered. Any reactivation or subsequent use of the advertisement beyond the initial advertising period will not be counted towards the 6-month obligation stipulated in clause (a).

    e. Olive Grove Estates reserves the right to provide a detailed breakdown of media costs incurred, and you agree to review and accept these costs based on the terms outlined in this agreement.

    f. In the event of any dispute regarding media costs, both parties agree to engage in good-faith negotiations to resolve the matter promptly.

    g. This clause shall survive the termination or expiration of this agreement.

  4. Media Cost Calculation: a. Media costs will be calculated based on actual expenses incurred by Olive Grove Estates for promoting and marketing your property. b. A detailed breakdown of media costs will be provided to you upon request or as part of the final invoice.

  5. If you decide to take advantage of the optional extras we provide to sell your property, we will generate invoices for the services rendered upon your request. It is crucial to understand that these payments for optional extras are distinct from the commission owed to our agency upon the successful completion of the sale. Additionally, please note that any money spent on these services up to the current date is non-refundable.In the event that you have not utilized the full amount allocated for optional extras, we will handle the remaining funds in accordance with our terms and conditions. This may involve either returning the unused amount to you or deducting it from the commission charges upon the completion of the sale.

  6. Payment Terms: a. The media costs incurred will be invoiced to you promptly upon withdrawal from our services. b. Payment for media costs will be due within 30 days of the invoice date. c. Late payments may be subject to additional charges or interest. An additional 2.5% of the outstanding amount may be added per 30-day period the payment is late.

  7. Dispute Resolution: a. In the event of a dispute regarding media costs or any other matter related to our services, both parties agree to engage in good-faith negotiations to resolve the issue amicably. b. If an agreement cannot be reached through negotiation, either party may seek legal recourse as permitted by applicable laws.

  8. Limitation of Liability: a. Olive Grove Estates will exercise reasonable care and skill in providing its services. However, we shall not be liable for any indirect, consequential, or special damages arising from the failure to sell your property or any other circumstances related to our services.

  9. Governing Law: a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Olive Grove Estates operates.

  10. Entire Agreement: These terms constitute the entire understanding between Olive Grove Estates and you the vendor and supersedes any prior agreements, whether written or verbal, relating to the subject matter herein.

By engaging Olive Grove Estates’ services, you acknowledge that you have read, understood, and agreed to these terms and conditions.

Services – Applicable to Buyers:

  1. Mediation Services: a. Olive Grove Estate Agency will provide mediation services to facilitate your property purchase without charging any fees for our basic services. b. Our mediation services encompass property search assistance, organizing property viewings, supplying property information, and facilitating communication between you and the property seller. We can also aid in drafting contracts and other legal documents. Please note that it is advisable to have a legal professional review these documents. Additionally, we can provide assistance during the title deed transfer at the Notary, offering translation services and facilitating the handover of keys.

  2. Additional Services: a. Additional services requested by you, which go beyond the standard mediation services mentioned in section 2, may incur additional charges. b. Examples of such additional services may include translation services, assistance in creating appointments for TIE (Tarjeta de Identidad de Extranjero) cards, and help with the transfer of utilities.

  3. Charges for Additional Services: a. If you request any additional services beyond our standard mediation services, we will inform you in advance of any associated charges. b. The cost for additional services will be communicated to you, and your consent will be obtained before proceeding with the provision of these services.

  4. Payment Terms: a. Payment for additional services will be due upon receipt of the invoice, unless otherwise agreed upon. b. Invoices for additional services will include a detailed breakdown of the charges and any applicable taxes.

  5. Changes to Charges: a. Olive Grove Estate Agency reserves the right to revise the charges for additional services at any time. However, any changes will not affect the agreed-upon charges for services that have already been confirmed and provided.

  6. Third-Party Providers: a. In some cases, we may engage third-party providers to assist with the provision of additional services, such as translators or service providers for TIE card appointments or utility transfers. In such instances, you agree that the terms and conditions of those third-party providers may also apply.

  7. Limitation of Liability: a. Olive Grove Estate Agency will exercise reasonable care and skill in providing its services, including any additional services requested. However, we shall not be liable for any damages or losses arising from the provision of these services or any actions or omissions of third-party providers.

  8. Governing Law: a. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Olive Grove Estate Agency operates.
